Terms of Service

1. Agreement and operator

These Terms govern your use of Rostr at https://joinrostr.com and the related services provided by Wasdesign, LLC, a Utah limited liability company ("Rostr," "we," "us," or "our"). By using a feature that presents these Terms for acceptance, you agree to them. If you do not agree, do not create an account or use the service. If acting for an organization, you must have authority to bind it.

Our Privacy Policy explains how we handle personal information. Accepting these Terms is not consent to receive optional text messages. Questions and notices may be sent to support@joinrostr.com.

2. Eligibility and accounts

You must be at least 18 and have legal capacity to enter this agreement to create an account or use account features. Rostr is currently intended for users in the United States; supported SMS numbers are US mobile numbers. You must supply accurate account information and use a mobile number you control and are authorized to register. Do not register another person's number or share sign-in codes. Tell us promptly if you lose control of your number or suspect unauthorized account use.

You are responsible for your use of the service and for taking reasonable steps to protect your device and signed-in sessions. Verification of a phone number is not a background check, proof of legal identity, or endorsement of a person. Account recovery may require verification; we cannot transfer access based solely on a name or an organizer's request.

3. What Rostr provides

Rostr supplies tools for organizers and participants to coordinate meetups, event signups, guest counts, attendance, and related communications. Features depend on what is available in the service. Rostr is currently an unreleased preview; sample events are fictional, and public account sign-in, SMS delivery, and subscriptions are not yet available. We do not promise a release date or future feature.

An event's confirmation, waiting, or reservation status reflects the information and rules in the app. It is not a guarantee of attendance, safety, venue access, minimum turnout, or a third party's performance. Each dated event requires the actions shown for that date; signing in or saving a link does not automatically enroll you in future dates.

Rostr does not operate venues, book facilities on your behalf, supervise participants, or provide emergency services. Contact emergency services directly in an emergency. Do not rely on an app notification or SMS for urgent safety information.

4. Organizer and participant responsibilities

Organizers are responsible for their event descriptions, schedules, locations, rules, permissions, and lawful operation, including any venue requirements or separate participant agreements. Participants should independently assess an event and its organizer and verify important details. You are responsible for guests you add and for having authority to provide any information about others. Use anonymous guest counts rather than uploading sensitive information about guests.

Share event links carefully: people who receive a link may be able to see event details and participant information. Do not publicly distribute a link intended for a private group without authorization. Do not use Rostr to reveal private or sensitive information about another person.

Changing or canceling an app signup, deleting an account, or canceling an event does not cancel a booking, fee, or obligation with a venue or another third party. Arrange those changes separately. Participation in an in-person activity can carry risks; assess the conditions and follow applicable rules. These Terms do not waive claims for harm that cannot lawfully be waived.

5. Acceptable use

You may use Rostr only for lawful purposes consistent with these Terms. You must not:

• Send spam, unsolicited invitations or marketing; use purchased contact lists; enroll another person in messages without authorization; or bypass an opt-out or consent choice.
• Harass, threaten, impersonate, discriminate unlawfully, exploit a child, or promote illegal activity, fraud, or violence.
• Submit content that infringes another person's privacy, intellectual property, or other rights.
• Upload malware, disrupt service, evade access controls or usage limits, misuse private event links, scrape personal information, or attempt to access another user's account or restricted data.
• Sell or sublicense access to Rostr, or copy or reverse-engineer protected portions of the service except to the extent applicable law permits despite this restriction.

Report abuse or a security concern to support@joinrostr.com. We may investigate and restrict abusive activity, but do not undertake to monitor every event or verify every user's identity or content.

6. Your content and our service

You retain rights in the content you submit. You give Wasdesign, LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, and display that content only as reasonably needed to operate, secure, and provide the service you request, including displaying event information to people with the appropriate access. We may use service providers to do this on our behalf. This license does not authorize selling your content or using private event content in advertising without separate permission. It ends when the content is deleted, except for copies reasonably retained as described in our Privacy Policy and uses already authorized by you.

You must have the rights needed to submit your content and grant this limited license. Rostr's software, branding, and other service materials belong to us or our licensors. Subject to these Terms, we grant you limited, nonexclusive, nontransferable permission to use the available service for its intended purpose. Third-party and open-source materials remain subject to their own licenses.

For a claimed intellectual-property infringement, contact support with the material's location, an explanation of your rights and the alleged infringement, and your contact details. Do not send knowingly false reports. This contact process does not represent that Rostr has a registered DMCA agent.

7. Text messages

When available, Rostr account and event messages include requested sign-in verification codes, account notifications, signup confirmations, event changes or cancellations, attendance notices, and reminders or recurring-event invitations you separately elect to receive. Messages may be sent using automated technology. Rostr does not send advertising under this program.

Consent: You request verification texts through the sign-in flow. Event-update consent and optional reminder or invitation consent are separate choices presented with the relevant feature. Providing a phone number, agreeing to these Terms, or joining an event does not by itself enroll you in optional texts. SMS consent is not a condition of purchase, and event SMS is not required to sign up for an event. Phone verification may nevertheless be necessary to establish an account. You must be the number's subscriber or otherwise authorized to consent to texts to that number.

Frequency and charges: Verification messages are sent when requested. Event-message frequency varies with your activity, the events you join, and your selected preferences. Message and data rates may apply under your mobile plan. Rostr does not impose a separate per-text charge on recipients. Check with your carrier about your plan's charges and supported services.

Opt out: Reply STOP to the sending number to stop Rostr texts from that number. You may receive one confirmation of your request. You may also contact support to withdraw consent. Opting out does not cancel an event signup or account. Sender-level suppression may prevent login codes from the same number, and we will not use a different sender to circumvent an opt-out. Where supported, reply START to resubscribe at the sender level, then select any desired program-specific preferences; this does not automatically enroll you in all event messages.

Help: Reply HELP to a Rostr message or email support@joinrostr.com. If you change or relinquish a number, update or close the associated account and withdraw its messaging consent before the change where possible.

Delivery: Delivery depends on carriers and other providers and may be delayed, blocked, or unavailable. Carriers are not liable for delayed or undelivered messages. Nothing in this provision limits liability that applicable law does not permit to be limited. Always check the event page or organizer for important changes. Our Privacy Policy explains how we protect mobile information and consent records.

8. Fees and future paid features

The current public preview does not offer a paid subscription. If we introduce paid features, the price, billing frequency, applicable taxes, renewal terms, cancellation method, and any trial or refund terms will be presented before you authorize a purchase. Merely visiting Rostr or accepting these Terms does not authorize a charge. We will not convert a free account into a paid subscription without your authorization. Mandatory cancellation and refund rights under applicable law remain. Any separate venue or organizer charges are their responsibility and are not payments to Rostr.

9. Third-party services

You may choose to use a venue, payment provider, or other independent third-party service linked from Rostr. Your relationship with that service is governed by its terms. We are not responsible for that service's independent acts or omissions. Our use of infrastructure providers does not remove our own obligations under these Terms or applicable law.

10. Changes, suspension, and ending use

We may update or discontinue features and may limit or suspend access when reasonably needed to address security risks, unlawful activity, material breaches of these Terms, legal requirements, or operational problems. When practical and lawful, we will explain a restriction and provide an opportunity to address it. For a permanent service shutdown, we will provide reasonable notice where practical and appropriate instructions for requesting your information.

You may stop using Rostr at any time and contact support to request account closure. Information is handled under the Privacy Policy, including permitted retention. Ending access does not erase obligations already incurred. Provisions that by their nature should continue, including ownership, permitted retention, limitations of liability, and dispute provisions, survive termination.

11. Service disclaimers

To the extent permitted by applicable law, Rostr is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted or error-free operation. We do not guarantee that users will attend, a venue will be available, messages will arrive, or content supplied by others will be accurate. We do not exclude any warranty or consumer protection that cannot lawfully be excluded.

12. Limits on liability

To the extent permitted by applicable law, Wasdesign, LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profits, business, or data arising from use of the service. Our aggregate liability for claims arising from or relating to the service or these Terms will not exceed the greater of US $100 or the amount you paid us for the service during the 12 months before the event giving rise to the claim.

These exclusions and cap do not apply to fraud, willful misconduct, gross negligence, or other liability that applicable law does not allow us to exclude or limit. They do not restrict statutory consumer remedies or liability for death or personal injury where such a restriction is prohibited. If a limitation is unenforceable, it applies only to the maximum extent permitted by law.

13. Governing law and disputes

Utah law governs these Terms, without applying rules that would select another jurisdiction's law, except that applicable federal law and mandatory protections of your home jurisdiction continue to apply. Contact support@joinrostr.com so we can try to resolve a concern informally. Contacting support is not a requirement that prevents you from meeting a legal deadline, seeking urgent relief, using small-claims court, or contacting a regulator.

A dispute may be brought in a court with jurisdiction under applicable law. These Terms do not require arbitration, waive class-action rights, impose an exclusive Utah forum on consumers, or shorten a legal limitation period.

14. Updates and general provisions

We may revise these Terms. We will post the updated version and date, and provide reasonable additional notice of material changes where appropriate or legally required. Changes apply prospectively. When new assent is required by law or the nature of a change, we will request it; posting a change alone does not establish that assent. If you disagree with a change, you may stop using the affected service and request account closure, subject to rights already accrued.

If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not transfer your account or contractual rights without our consent, except where law permits. We may transfer these Terms with a legitimate business transfer if the successor assumes our obligations and applicable privacy commitments; mandatory consumer rights are unaffected. These Terms and any additional terms you expressly accept for a specific feature are the agreement for that feature; they do not override nonwaivable rights or earlier promises that applicable law requires us to honor.
